Terms and Conditions UVSeQure

Language notice. These Terms and Conditions are provided in English for convenience. The Dutch version (Algemene Voorwaarden UVSeQure) is the authoritative version. In the event of any conflict or inconsistency between the Dutch and English versions, the Dutch version prevails.

Effective date: June 10, 2026 Last updated: July 1, 2026

These Terms and Conditions (the "Terms") govern the use of the UVSeQure mobile application (the "App"), provided by Weitzel Advies ("we", "us", "UVSeQure").

These Terms must be read together with the Privacy Policy and the in-app medical Disclaimer (shown on first launch, accessible at any time via Settings). Together they constitute the entire agreement between you and us regarding the App.

1. Acceptance and scope

By downloading, installing or using the App you accept these Terms, together with the Privacy Policy and the in-app Disclaimer. If you do not accept any of these documents, do not use the App.

The App is intended for users aged 16 or older, in line with the Dutch implementation of Article 8 GDPR. Persons under 16 may use the App only with the demonstrable consent of a legal representative.

These Terms apply to consumers within the meaning of Article 6:230g of the Dutch Civil Code (Burgerlijk Wetboek — "BW") and contain the mandatory provisions of EU Consumer Rights Directive 2011/83/EU as implemented into Dutch law (in particular BW 6:230m et seq.).

2. Identity of the provider

Pursuant to Article 6:230m BW:

  • Name: Weitzel Advies
  • Legal form: sole proprietorship
  • Website: https://uvsequre.com
  • Chamber of Commerce (KvK) number: 56031254
  • VAT number: NL001904225B08
  • Email: contact@uvsequre.com

3. Description of the service

UVSeQure is a mobile application that:

  • uses voluntarily provided profile information (Fitzpatrick skin type, date of birth, gender, preferred SPF level, activity, selected city or location preference), which is stored exclusively locally on your device;
  • when you request a recommendation, sends your profile information and location once to our server, where it is used solely to calculate the recommendation and then immediately discarded; we do not store any profile, location or usage data on our servers;
  • retrieves weather and UV-index data for your location from an external provider;
  • on the basis of our own interpretation of publicly available scientific literature, gives non-binding recommendations for SPF level and reapplication intervals;
  • runs an in-app reapplication timer and, if you enable it, sends reminders via local notifications scheduled entirely on your own device.

No registration is required to use the App.

UVSeQure does not provide medical advice, diagnosis or treatment; does not function as a medical device within the meaning of Regulation (EU) 2017/745 (MDR); and does not guarantee the accuracy of weather, UV or location data from external providers.

4. Disclaimer

The full Disclaimer is shown on first launch of the App and is accessible at any time via Settings. For convenience, the key points:

  • The App is an informational tool. Recommendations are our own interpretation of publicly available scientific literature on UV radiation and sun protection.
  • The App is not a medical device within the meaning of the MDR (Regulation (EU) 2017/745) and is not certified as such. It is not intended to diagnose, prevent, monitor, predict, treat or alleviate diseases, including skin cancer.
  • The recommendations are not medical advice and are not a substitute for consultation with a qualified healthcare professional. Always consult a doctor or dermatologist for personal advice, in particular in case of a history of skin cancer or precancerous conditions, use of photosensitising medication, an autoimmune or light-sensitive disorder, pregnancy or breastfeeding, or when choosing sun protection for an infant or young child.
  • Sunscreen reduces, but never fully prevents, the risk of sunburn or long-term damage from UV. Always combine sunscreen with shade, protective clothing, a wide-brimmed hat and UV-blocking sunglasses.
  • Stop using a sunscreen product and consult a doctor in case of an unusual skin reaction. Have any new, changing or non-healing skin spot assessed by a doctor as soon as possible.

By accepting these Terms, you confirm that you have read and accepted the in-app Disclaimer.

5. Your data on your device

Your profile information (such as skin type, date of birth, gender and preferences) is stored exclusively locally on your own device. This means:

  • when you start using the App, you declare that you are 16 or older, or that you are acting with the demonstrable consent of a legal representative;
  • you are responsible for entering accurate profile information; the quality of the recommendations depends on the accuracy of the data you provide;
  • your data exists only on your device; we cannot access, recover or transfer it. If you delete the App or clear the App's data, your profile and settings are permanently deleted;
  • the App is intended for personal use on devices you own or control.

6. Acceptable use

You agree not to use the App:

  • in violation of any applicable Dutch, European or other law;
  • to seek access to data or systems that do not belong to you;
  • to reverse-engineer, decompile or disassemble the App, except to the extent mandatory law permits (in particular Article 6 of Directive 2009/24/EC on interoperability);
  • to scrape, crawl or harvest data, or to use automated tools that place a disproportionate load on our systems;
  • to circumvent, disable or interfere with security or abuse-prevention measures;
  • to infringe our intellectual property rights or those of third parties;
  • to send malware, spam or unlawful content.

We may restrict or block access to our servers in case of a breach, in a manner proportionate to the seriousness of the breach and, where reasonably possible, after prior notice.

7. Intellectual property

All intellectual property rights in the App — including the source code, the design, the brand, the name, the logo, the texts, illustrations, the algorithm and its associated parameters — are and remain the property of Weitzel Advies or its licensors.

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable and non-sublicensable licence to download, install and use the App on devices you own or control, solely for your personal, non-commercial use.

You retain all rights to the data you enter into the App. By sending data along with a request, you grant us only the licence necessary to calculate the recommendation, as further described in the Privacy Policy.

Open-source components in the App are licensed under their own respective licences.

8. Availability of the service

We strive to keep the App available and reliable, but we provide no formal availability guarantee. You acknowledge that:

  • the App depends on third-party services beyond our control, including Apple, Google, OpenWeatherMap, Expo and our hosting provider;
  • outages, delays or restrictions at these third parties may affect the App, and we are not liable for them except to the extent mandatory law provides otherwise;
  • we may schedule maintenance windows during which the App is temporarily unavailable; we will announce substantial planned maintenance in advance where reasonably possible.

9. Changes to the service

We may add, modify or remove features in the App, in particular to improve the algorithm or user experience, to comply with legal requirements, to respond to changes by external providers, or to address security or operational issues.

10. Changes to these Terms

We may amend these Terms, for example to comply with new legal requirements, to reflect changes to our service, to correct ambiguities, or to describe new App functionality.

For material changes, we will ask you to expressly accept the amended Terms at the next App launch before you can continue using the App. If you do not accept, you may stop using the App and delete it; until acceptance, the previous Terms continue to apply to your use.

Changes that are solely to your benefit, or that are necessary to comply with mandatory law, may take effect without a prior notice period.

11. Termination

11.1 Termination by you

You may stop using the App at any time by deleting it from your device. Because all of your profile information is stored exclusively locally on your device and we retain no data about you, deleting the App also deletes all of your data. There is nothing to cancel or delete on our side.

11.2 Termination by us

We may restrict or block access to our servers:

  • in case of a material breach of these Terms, in a manner proportionate to the seriousness of the breach and, where reasonably possible, after prior notice, or
  • immediately in case of a serious breach (fraud, abuse of the service, attempts to compromise our systems, or use for unlawful purposes), or where the law requires it.

We may also discontinue the service as a whole; we will announce a substantial discontinuation in advance where reasonably possible via an in-app message or via our website.

11.3 Consequences of termination

Upon termination, the licence under §7 lapses immediately and you must stop using the App. Because we retain no personal data about you, no deletion is required on our side; you delete your local data by deleting the App. Provisions that by their nature are deemed to survive termination remain in force.

12. Liability

UVSeQure shares information and recommendations on the basis of publicly available scientific literature on UV radiation and sun protection. This information is expressly not medical advice and is not a substitute for consultation with a doctor, dermatologist or other qualified healthcare professional. You use the App at your own responsibility.

12.1 What we cannot exclude or limit

Nothing in these Terms excludes or limits our liability for:

  • intent or gross negligence of us or of our managerial subordinates;
  • fraud or fraudulent misrepresentation;
  • any liability that cannot be excluded or limited under mandatory consumer law.
12.2 What we do exclude

To the extent permitted by law, we exclude liability for:

  • indirect or consequential damages, including lost profits, lost revenue, business losses, reputational damage and lost opportunities;
  • loss of data stored locally on your device, for example through deletion of the App, loss of or damage to your device, or clearing the App's data;
  • damage caused by third-party services (Apple, Google, Expo, OpenWeatherMap, our hosting provider, your network provider) over which we have no reasonable control;
  • local notifications not firing, or not firing on time, as a result of settings or restrictions of your operating system (such as battery optimisation or do-not-disturb mode);
  • damage arising from your failure to follow the in-app Disclaimer or general common-sense rules regarding sun protection;
  • health damage arising from following our recommendations instead of personal advice from a qualified healthcare professional;
  • damage arising from your misuse of the App or your breach of these Terms.
12.3 Statutory rights preserved

This article does not affect your statutory rights under Dutch and European consumer law that cannot be contractually excluded.

13. Indemnification

You will indemnify us against third-party claims arising from your misuse of the App, your breach of these Terms, or your violation of applicable law in connection with your use of the App. This indemnification does not apply to the extent the claim results from our own fault or negligence, or to the extent that mandatory Dutch consumer law limits the indemnification.

14. Force majeure

Neither party is liable for any failure or delay in performance of its obligations, to the extent caused by an event beyond its reasonable control (such as natural disasters, civil unrest, government measures, internet or telecommunications outages, outages at external providers, or comparable events). The affected party will inform the other as soon as reasonably possible and resume performance once the cause has been removed.

15. Severability

If any provision of these Terms is held by a competent court or authority to be invalid or unenforceable, that provision will be amended to the minimum extent necessary to make it valid, or, if amendment is not possible, deleted. The remaining provisions will remain in full force and effect.

16. Governing law and dispute resolution

These Terms are governed by Dutch law, without prejudice to the mandatory consumer protection of the country in which you reside.

We strive to resolve disputes amicably in the first instance. For questions or complaints, you may contact us at contact@uvsequre.com; we strive to respond substantively within 14 days.

If we cannot resolve the matter between us, you retain the right at all times to bring your dispute before the competent court in accordance with mandatory Dutch consumer law.

17. Entire agreement

These Terms, together with the Privacy Policy and the in-app Disclaimer, constitute the entire agreement between you and us regarding the App. In the event of a conflict between these documents, the following order of precedence applies:

  1. mandatory provisions of applicable law;
  2. these Terms;
  3. the Privacy Policy;
  4. the in-app Disclaimer.
